for Email Accounts

This Policy represents eOrders, llc. Terms of Service Policy applicable to you and your subsidiaries and supersedes any other written or oral Policy. We reserve the right to revise this Policy at any time.

By using any of the services offered by us, you are bound by and must comply with this Policy in its entirety. Violations of the guidelines, delineated below, will result in cancellation of your services or such other action as we, in our sole discretion, may deem appropriate.

SECTION 1. CANCELLATION
eOrders, llc. reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by eOrders, llc. if eOrders, llc. institutes it's right of cancellation. Any violation of policies which results in extra costs will be billed to the customer.


SECTION 2. YOUR REGISTRATION OBLIGATIONS
In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form. If you provide any information that is untrue, inaccurate, not current or incomplete, or eOrders has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, eOrders has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

You must be over the age of 16 to use eOrders Email Service.


SECTION 3.  SYSTEM AND NETWORK SECURITY
a)     You may not tamper with other accounts, or commit unauthorized intrusion into any part of our system, or use any of our machines, files, accounts, networks to intrude without authorization into any other system.

b)     You may not use any of our services not included in your account, nor devise ways to circumvent security in order to access services you are not paying for. This clause includes, but is not limited to, the scanning of our network or other networks with intent to breach and/or evaluate security.

c)     You may not use the system in a manner that encumbers disk space, processors or other system resources beyond those allowed by the specific type of account. You may not make deliberate attempts to interfere with a service, overload a service nor attempt to disable a host. If your account causes our servers to become overloaded due to high CPU or disk usage, we reserve the right to suspend or cancel your account without warning.

d)     We will react strongly to the use or attempted use of Internet services or systems without the owner's authorization. This clause includes, but is not limited to, password cracking, defrauding others into releasing their passwords, denial-of-service attacks (sending packets with an illegal packet size, UDP flooding, ping-flooding, half-open TCP connection flooding, etc.). Additionally, you may not use programs, scripts, commands nor send messages with the intent to interfere with a user's terminal session.

SECTION 4. EMAIL ABUSE
a)     Using mail services, mail forwarding capabilities, POP accounts, or autoresponders other than for a customer's own account is not allowed.

b)     You may not send unsolicited email to any account that has not specifically requested information or that causes complaints from the recipients of such unsolicited email.

c)     You may not continue to send commercial email to a recipient if that recipient has requested a discontinuation of such communication.

d)     We prohibit the transmission of email that is harassing, libelous, defamatory, legally obscene or pornographic, threatening, abusive or hateful to non-consenting recipients.

e)     The forwarding or propagation of chain letters of any type (including charity requests or petitions for signatures) is impermissible.

f)       "Mailbombing" (i.e. flooding a user or site with large or numerous email messages) is strictly prohibited.

g)     You may not forge header information.

h)     We prohibit the use of your account, or network connection, to collect replies of messages sent from any another provider that violates the rules of this Policy or those of the originating provider.

i)        The rules and regulations contained within this Policy apply to other means of Internet-based transmissions, including, but not limited to Internet fax or Internet phone.

SECTION 5.  LAWFUL PURPOSES
eOrders, llc. reserves the right to refuse service to anyone. Customers may only use eOrders, llc. server for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. eOrders, llc. expressly forbids anyone from using eOrders, llc. servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of eOrders, llc. management.

SECTION 6.  GENERAL

  1. Internet connections and all other services provided to you by us may only be used for lawful purposes. Transmission or storage of any information, data or material in violation of any U.S. Federal or state regulation or law is prohibited. This includes, but is not limited to, material protected by copyright, trade secret or any other statute, threatening material or obscene material. We reserve the right to remove any and all materials that infringe on copyright work. Such materials may be removed at any time upon receiving a complaint and/or notice of alleged copyright infringement.
  2. Certain Internet services may contain language, pictures or other content which some individuals may find offensive, inflammatory, or of an adult nature. We do not endorse such materials and disclaim any and all liability for such content. Access to such materials is at your own risk.
  3. Use of any information obtained via our service is at your own risk. We specifically deny any responsibility for the accuracy or quality of information obtained through our services.

7. Indemnification
Customer agrees that it shall defend, indemnify, save and hold eOrders, llc. harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against eOrders, llc., its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless eOrders, llc. against liabilities arising out of;

(1)   any injury to person or property caused by any products sold or otherwise distributed in connection with eOrders, llc.'s server;

(2)    any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;

(3)    copyright infringement and

(4)    any defective products sold to customer from eOrders, llc.'s server.

8.  Backup of Individual Accounts
Although we do periodically backup individual accounts, customers must understand that our backups are meant for whole servers, not individual accounts. Customer must therefore ensure that their accounts are individually backed up by themselves at least every day. eOrders, llc. will not be held responsible for loss data to individual accounts.  It is important for customers to understand that their daily backup may at times be more current than our backup. They must also understand that restoring all account on a given server after a server crash can take up to 72 hours. A customer with a personal, current backup may, at times, be able to restore their own account faster than us. We therefore highly recommend backing up your accounts personally every day.

9.  Disclaimer
eOrders, llc. will not be responsible for any damages your business may suffer. eOrders, llc. makes no warranties of any kind, expressed or implied for services we provide. eOrders, llc. disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by eOrders, llc. and its employees. eOrders, llc. reserves the right to revise its policies at any time.
